Rights of child victims of trafficking

Children victims of trafficking have special rights to protection, support, and care that take their age and best interests into account.

Right to tailored assistance and protection
  • Authorities and support organisations must assess their situation individually and make decisions based on what is best for them.
  • If their age is unclear but there are reasons to think they are a minor, the law assumes they are a child until proven otherwise.
Right to protection during criminal investigations and court proceedings
  • The child has the right to be protected from harm and stress while authorities investigate the crime or during any legal process.
  • Special measures should be taken to prevent unnecessary distress.
Right of unaccompanied children to assistance and protection
  • If the child is alone without a parent or guardian, they have the right to receive full protection and support
  • Authorities must ensure they have safe accommodation, access to education, and all necessary care.

These rights exist to make sure that the child is kept safe, supported, and able to recover, and that decisions affecting them always prioritise their well-being and safety.
