Victim's rights

In Spain, victims of gender violence have a series of specific rights:

  • Right to financial aid for women with special difficulties in finding a job.
  • Right to immediate schooling of children if they change their place of residence.
  • Right to change surnames or identity.

Right to information and legal advice

Right to comprehensive social assistance

which includes social care, emergency, support and shelter, and comprehensive recovery services. The right to comprehensive social assistance is also recognized for minors who live in family environments where gender violence exists.

Right to free legal assistance

regardless of the financial resources you have. It will be provided immediately in those judicial processes and administrative procedures that have a direct or indirect cause in the violence suffered.

Rights aimed at seeking to reconcile work with the situation of gender violence

The protection of victims is guaranteed if they are forced to leave their jobs, either temporarily or permanently, and their job placement is sought if they are not employed. There are also rights related to Social Security, in terms of contributions and benefits.

Foreign women in an irregular administrative situation have specific right

If, when a situation of gender violence is reported, the irregular situation of the foreign woman is revealed

1. The administrative sanctioning procedure will not be initiated for being irregularly in Spanish territory (serious infraction).

2. The administrative sanctioning procedure that had been initiated for the commission of said infraction prior to the complaint or, where appropriate, the execution of the expulsion or return orders eventually agreed upon will be suspended.
